    POOL REGISTRATION FORM

    As the parent or legal guardian of the following minors between the ages of 9 and 17, you authorize their use of the Wheatlands pool facilities without your presence and without the presence of another parent or legal guardian. (Please note each child will need to pass a swim test before he/she will be allowed to swim unaccompanied). In making such authorizations, you acknowledge and agree that activities by said minor may be wholly unsupervised by a lifeguard or other attendant and shall be at the minor’s sole and unilateral risk.

    In addition, you authorize the following minor(s) at least 13 years old, to supervise, chaperone, and monitor other minors (for which you are the parent or legal guardian) at the Wheatlands pool facilities, without your presence, and without the presence of another parent or legal guardian.


    Wheatlands Metropolitan District Waiver and Consent

    Please read carefully before signing. This document includes a release of liability and waiver of certain legal rights.

    Individual and Parent/Legal Guardian Waiver of Liability and Release Form

    Every person, or a parent/legal guardian of a person under the age of 18, desiring to use Facilities (as defined below) or participate in Recreational Activities (as defined below) on property owned or maintained by Wheatlands Metropolitan District (the “District”) including, but not limited to swimming facilities, parking facilities, clubhouse facilities, multi-use fields, and other District-owned facilities (each a “Facility” and together the “Facilities”) must complete this Waiver of Liability and Release Form.

    It is possible that you (or your child/ward) may be injured while participating in activities at the Facilities including, but not limited to swimming, exercising, running, climbing, and sports (such as soccer, football, and lacrosse) (each a “Recreational Activity” and together the “Recreational Activities”), either because of your (or your child/ward’s) own conduct, conduct of others, conduct of the District, or the condition of the Facilities.

    The District wants to make sure that you understand the potential risk of injury before you decide to participate in Recreational Activities. It is required that you read this Waiver of Liability and Release Form very carefully and make sure you understand it. By signing below, you certify that, in advance of participation in any Recreational Activity, you have received any and all information that you deem necessary or important in making an informed choice regarding your own or your child/ward’s participation in such Recreational Activity.

    You recognize and acknowledge that participation in Recreational Activities involves risk of serious injury and loss. Such loss and injury may include bodily injury, slipping and falling, cardiovascular stress, drowning, permanent disability or death, damage to personal property (including vehicles), exposure to inclement weather, insect or animal bites and severe social and economic losses, which might result from your action, inaction, the negligence of others, the rules of play, or the condition of the Facility or any equipment used thereon. Further, by signing below, you certify that you understand that these are some, but not all of the risks; there may be other risks and dangers, a complete listing of which is not possible and cannot be anticipated. By signing below, you certify that you shall assume all such risks and dangers, whether or not described here, known or unknown, anticipated or unanticipated.

    You further acknowledge that you are legally responsible for your actions, your child/ward’s actions (if applicable), and your guests’ actions (if applicable), including, but not limited to, any damage to private or public property and/or personal injury.

    You agree to indemnify and hold the District, its officers, employees, agents, consultants and representatives, harmless from any claim, liability, damage, loss or injury (including death) which may result from your participation, your child/ward’s participation, or your guests’ participation in any Recreational Activity. This release of liability and indemnity applies equally to losses, damages or injuries caused or alleged to be caused in whole or in part by the negligence of the District. You further agree to release, waive and discharge, and covenant not to sue the District, its officers, employees, agents, consultants and representatives, for any and all claims, demands or causes of actions whatsoever arising out of any claim, liability, damage, loss or injury (including death) incurred on or to you or your child/ward as a direct or indirect result of your participation (or your child/ward’s) in any Recreational Activity. This release of liability and indemnity applies to you, the undersigned, your child/ward, as well as any of your personal representatives, assigns, heirs and next of kin.

    You agree that you have received sufficient information regarding the Recreational Activities to assess the potential degree of risk involved, and the extent of possible injury, understand the activities and potential risks, have carefully read and fully understand the effect of relinquishing the rights that you hereby waive, and voluntarily sign this Waiver of Liability and Release Form.

    In addition, you acknowledge that you are required to pay ongoing District fees as set forth in the District’s fee resolutions, and that such fees, until paid, shall constitute a perpetual lien on and against your property, which may be foreclosed upon by the District. You further acknowledge that failure to pay any District fees may result in the revocation of privileges to use the Facilities. You, on behalf of yourself, spouse, family members, heirs and/or estate, as partial consideration for the use of the Facilities hereby forever waive and release any homestead exemption in connection with your property located within the District.

    Wheatlands Metropolitan District Waiver of Liability and Release - Use of Pool(s) During COVID-19

    Every person, or a parent/legal guardian of a person under the age of 18 (the “Minor”), desiring to use or participate in activities on/in/around the swimming pool(s) and related facilities (collectively, the “Pool”) of the Wheatlands Metropolitan District (the “District”) must complete this Waiver of Liability and Release (the “Waiver and
    Release”).

    COVID-19 coronavirus (“COVID-19”) is extremely contagious and is believed to spread mainly from person-to-person contact. Methods of transfer include, but are not limited to, physical contact, contact through breath, and contact with stable surfaces. Additional Information about COVID-19 and COVID-19 symptoms may be found at https://www.cdc.gov/coronavirus/2019-ncov/index.html and https://covid19.colorado.gov/about-covid-19. The District wants to make sure that you understand the potential risks of COVID-19 before you decide to use the Pool. There may be other risks and dangers, a complete listing of which is not possible and cannot be anticipated, and you assume all such risks and dangers, whether or not described here, known or unknown.

    By signing this Waiver and Release, you recognize and acknowledge the contagious nature of COVID-19 and the threat that COVID-19 poses to the health of individuals, and you voluntarily and knowingly assume the risk that you or your Minor may be exposed to or infected by COVID-19 at the Pool, and that such exposure or infection may result in personal injury, illness, permanent disability, and/or death. You understand and acknowledge that the risk of becoming exposed to or infected by COVID-19 at the Pool may result from the actions, inactions and/or omissions of yourself and/or others.

    By signing this Waiver and Release you certify that you have received any and all information that you deem necessary or important in making an informed choice regarding your own or your Minor’s use of the Pool, and you voluntarily agree to assume all risks and accept sole responsibility for any injury to you or your Minor (including, but not limited to, personal injury, disability, death, illness, damage, loss, claim, liability, or expense, of any kind), that you or your Minor may experience or incur in connection with attendance at the Pool.
    You agree to indemnify and hold the District, its officers, employees, agents, consultants, independent contractors, and representatives (collective, the “District Indemnitees”) harmless from any claim, liability, damage, loss, injury (including death), cost or expense relating to COVID-19 which may result from your participation, or the participation of your Minor, in any activity in or around the Pool. You further agree to release, waive and discharge, and covenant not to sue the District.

    Indemnities for any and all claims, demands, losses, costs, expenses or causes of action whatsoever arising out of any claim, liability, damage, loss or injury (including death) relating to COVID-19 as a direct or indirect result of your participation, or your Minor’s participation, in any activity at the Pool. This release of liability and indemnity applies to you, the undersigned, your Minor, as well as any of your personal representatives, assigns, heirs and next of kin. By signing this Waiver and Release, you agree that you and your Minor will only use the Pool and participate in pool activities while in good health and free of COVID-19 symptoms, including, but not limited to, fever, cough, or shortness of breath.

    If Minors under 18 years of age will be utilizing the pool, parent or guardian must read and sign below:
    I am the parent or legal guardian of the minor(s) listed above. I acknowledge that I have read this Waiver and Release and have full knowledge and understanding of its contents. I hereby agree to the terms of the Waiver and Release on behalf of the named minor(s), and give my consent for the named minor(s) to utilize the District’s Pool. I acknowledge that by signing this Waiver and
    Release on behalf of the minor(s) that the minor(s) shall be bound by all terms of this Waiver and Release.

    You agree that you: (1) have received sufficient information regarding the use of the Pool to assess the potential degree of risk involved, and the extent of possible injury; (2) understand the activities and potential risks; (3) have carefully read and fully understand the effect of relinquishing the rights that you hereby waive; and (4) voluntarily sign this Waiver and Release.

    Wheatlands Metropolitan District Waiver of Liability and Release – Swim at Your Own Risk
    NO LIFEGUARD ON DUTY

    Every person, or a parent/legal guardian of a person under the age of 18 (“Minor”), desiring to use or participate in Swim at Your Own Risk at the swimming pool(s) (the “Pool”) of the Wheatlands Metropolitan District (the “District”) must complete this Waiver of Liability and Release – Swim at Your Own Risk (the “Waiver and Release”).

    PLEASE READ THIS WAIVER AND RELEASE VERY CAREFULLY AND MAKE SURE YOU UNDERSTAND IT. BY SIGNING THIS DOCUMENT, YOU CHOOSE TO WAIVE CERTAIN LEGAL RIGHTS.

    No lifeguard will be present at the pool during the hours of 12:00 p.m. to 4:00 p.m. from August 8 to September 5, 2023 (“Swim at Your Own Risk Hours”.) You understand that as a condition of your use of the Pool when no lifeguards are present, and potentially no other person will be present, you execute and agree to this Waiver and Release and will abide by its terms. It is possible that you or your Minor(s) may be injured while participating in activities at the Pool without lifeguard supervision either because of your or your Minor(s) own conduct, conduct of others, conduct of the District, or the condition of the Pool. The District wants to make sure that you understand the potential risk of injury before you or your Minor(s) use the Pool during Swim at Your Own Risk Hours. It is required that you read this Waiver of Liability and Release Form very carefully and make sure you understand it. By signing this Waiver and Release you certify that you have received any and all information that you deem necessary or important in making an informed choice regarding your own or your Minor(s)’ use of the Pool during Swim at Your Own Risk Hours, and you voluntarily agree to assume all risks and accept sole responsibility for any injury to you or your Minor(s) (including, but not limited to, personal injury, disability, death, illness, damage, loss, claim, liability, or expense, of any kind), that you or your Minor(s) may experience or incur in connection with use of the Pool during Swim at Your Own Risk Hours.

    You recognize and acknowledge that NO LIFEGUARD IS PRESENT at the Pool during Swim at Your Own Risk Hours. You recognize and acknowledge that pool staff such, as pool monitor(s) who may be present to enforce the pool rules during regular operating hours, are not lifeguards and do not assume lifeguard duties. You agree to agree to assume all risks and accept sole responsibility for any injury to you or your Minor(s) (including, but not limited to, personal injury, disability, death, illness, damage, loss, claim, liability, or expense, of any kind), that you or your Minor(s) may experience or incur related to the use of the pool without lifeguard supervision.

    You understand that swimming and other activities at the Pool are inherently dangerous activities, the risks of which include but are not limited to, death and serious bodily injury, due to possible malfunctions of pool equipment, weather, conditions of the Pool, falls, heart attack or stroke, or other infirmity, the conduct of other swimmers, and the risk that no one may be present to assist you if you have an injury. You are aware of all of the risks and warnings, and, with that information, you execute this Waiver and Release. You AFFIRM THAT YOUR USE OF THE POOL IS VOLUNTARY AND AT YOUR OWN RISK

    You agree to indemnify and hold the District, its officers, employees, agents, consultants, independent contractors, and representatives (collective, the “District Indemnitees”) harmless from any claim, liability, damage, loss, injury (including death), which may result from your participation, or the participation of your Minor(s), in any activity in or around the Pool during Swim at Your Own Risk Hours. You further agree to release, waive, relinquish, discharge, and covenant not to sue the District Indemnitees for any and all claims, demands, losses, costs, expenses or causes of action whatsoever arising out of any claim, liability, damage, loss or injury (including death) as a direct or indirect result of your participation, or your Minor(s)’ participation, in any activity at the Pool during Swim at Your Own Risk Hours. This release of liability and indemnity applies to you, the undersigned, your Minor(s), as well as any of your personal representatives, assigns, heirs and next of kin.

    You agree that you: (1) have received sufficient information regarding the use of the Pool during Swim at Your Own Risk Hours to assess the potential degree of risk involved, and the extent of possible injury; (2) understand the activities and potential risks; (3) have carefully read and fully understand the effect of relinquishing the rights that you hereby waive; and (4) voluntarily sign this Waiver and Release.
